General terms and conditions of business

Note: For better readability, the generic masculine form is used in these general terms and conditions. The personal designations used in these terms and conditions refer to all genders, unless otherwise indicated.


§ 1 The following conditions apply exclusively to the lessons. Oral side agreements, changes and additions to the lesson contract must be in writing. This written form clause can also only be changed or revoked in writing. The legal invalidity of individual parts of the contract does not affect the validity of the remaining parts of the contract.


§ 2 The OnStage Musikfabrik offers musical education, participation in music groups (especially early musical education) as well as individual and group lessons for children and adults.


§ 3 Music lessons and the various music courses take place regularly, on the days and times specified at the start of the contract. The exception to this are prepaid offers (e.g. 5-ticket cards). In these cases, individual teaching units are agreed directly with the respective teacher. Excluded from lessons, i.e. time without lessons, are school holidays in accordance with the general holiday regulations in Bavaria and public holidays including Repentance Day.


§ 4 There is a choice between group and individual lessons as well as course lessons. In group lessons, the length of the lesson depends on the size of the group. In course lessons, there is a minimum size to be determined on a case-by-case basis.


§ 5 New students will be given a free, non-binding trial lesson. This trial lesson is designed to allow the student and teacher to get to know each other. Neither the student nor OnStage Musikfabrik is bound by this. Likewise, an agreed or carried out trial lesson is not a commitment on the part of the student with regard to a free place on the lesson.


§ 6 The tuition and course fees are based on the respective tuition and course fee regulations of OnStage-Musikfabrik, which can be viewed on the homepage www.onstage-musikfabrik.com.

Monthly installments are paid. Participation in the direct debit procedure (revocable direct debit authorization) is requested by the

OnStage Musikfabrik is requested. For this purpose, each student will be sent a SEPA direct debit mandate for each lesson contract. The due date is always the 1st of each month. In the event of late payment, a default interest rate of five percentage points above the base interest rate of the Bundesbank can be charged.


§ 7 An increase in the fee can only take place at the beginning of the school year and must be made according to the principles of equity.


§ 8 The teacher is not obliged to make up for lessons cancelled or missed by the student (§ 615 BGB). If the music teacher is unable to attend a lesson, the lesson will be made up or refunded by agreement. If the teacher is absent twice per school year due to illness, the lesson will not be refunded. If the lesson is cancelled for reasons for which the music school is responsible (training, music school events, etc.), the lesson will be made up if possible. For this purpose, additional lesson times can be set and students can be grouped together. Lessons are cancelled for school concerts and music school events in which students are involved. If lessons are cancelled due to forces beyond our control, the music school is still entitled to compensation. If the student is ill for a long period of time, the pro rata fee will be waived after four weeks.


§ 9 The music student can be excluded from lessons by OnStage Musikfabrik with immediate effect

a) in the event of significant delay in payment of the respective tuition fees,

b) in the case of serious misconduct, such as disruption of the course of lessons, improper behaviour

towards classmates and/or teachers as well as in similar incidents.

c) in the case of frequent and repeated, unexcused absence of the student from class


§ 10 After the contract period agreed in the teaching contract has expired, a notice period of two weeks to the end of the month applies. In justified applications, and with the approval of the teacher and the headmaster, termination can also take place during the regular contract period. The student must provide evidence of an important reason for this and there must be a need for termination. If the student does not attend lessons during the notice period, this time reverts to the music school's control.


§ 11 Mainly at the end of the school year, occasionally also during the

§ 12 Lessons will take place exclusively in the rooms designated by OnStage Musikfabrik.


§ 13 The music school’s events, including the necessary preparations, are part of the lessons.

Participation and assistance by students is voluntary. As part of the event preparations, students can be grouped together and additional lessons can be held that deviate from the regular lesson plan. The music school is entitled to make image and sound recordings during lessons and at its events and to use them for its own purposes. The student or their legal representatives can object. Under certain circumstances, students can be excluded from events due to a ban on image and sound recordings if this could impair the smooth running of the event. Image and sound recordings for social media purposes will be communicated to the student or legal guardian in advance and explicit permission will be requested.


§ 14 By registering the child/student for music lessons, the legal guardians or students agree to the collection, storage and processing of personal data. The data in the lesson contract is collected, processed and used exclusively for the purpose of implementing the contract. It will only be passed on to third parties if this is absolutely necessary for the implementation of the contract. Every legal guardian/student has the right to revoke their consent to the storage, processing and use of their data at any time with effect for the future. Furthermore, the legal guardian/student has the rights to information and correction with regard to the data collected as set out in the Federal Data Protection Act. § 15 In principle, students should own an instrument when they begin instrumental lessons. For the transition period, loan instruments can be obtained from OnStage Musikfabrik - depending on availability. A rental fee is charged for care/maintenance and provision of the instrument.


§ 16 If contagious diseases occur (especially flu and corona), the general health regulations for schools apply. OnStage Musikfabrik also urges students to stay away from classes if they have cold or general symptoms of illness in order to avoid endangering fellow students and teachers.


§ 17 The student undertakes to treat the premises and the teaching materials, instruments, sheet music and other objects and utensils provided by the teacher and the OnStage Musikfabrik with care. Any damage must be reported immediately to the teacher or the institute management.


§ 18 If face-to-face lessons cannot take place for important reasons, the lessons can be held as online lessons. In this case, OnStage Musikfabrik offers various platforms and the necessary technical assistance to enable every student to take part in the online lessons.
